ROYALTY-FREE STOCK PHOTOS FOR COMMERCIAL AND NON-COMMERCIAL USE AVAILABLE BY SUBSCRIPTION

The following is a legal agreement between you and Vilords media ("Vilords media"). Please read this agreement carefully before downloading any AskPhotos.com stock photo ("Photo"). By downloading any photo, you agree to be bound by the terms of this agreement.

All photos are copyrighted. Vilords media or its suppliers own all rights to the Photos. All rights are reserved by Vilords media unless otherwise granted to you. Your rights to use the Photos are subject to this agreement and are conditional upon your payment for the Photos to Vilords media. If at any time your account becomes delinquent, you relinquish all rights to all Photos you have downloaded until all payments and interest are made. Account delinquency will result from unpaid invoices, and credit card chargebacks. As long as the user's account was current at the time the user downloaded a Photo, they have the right to use that Photo indefinitely, subject however, to the terms of this EULA.

Vilords media grants you a personal, non-exclusive, non-transferable, right to use Photos in the following ways:

1. On web sites, multimedia presentations, and broadcast film and video.

2. In magazines, newspapers, books, eBooks, pamphlets, brochures, catalogs, book covers, textbooks, editorials, toolbar skins, posters, mobile phones, greeting cards (paper or online), pagers, CD/DVD cover art, and advertising.

3. In connection with your business identity on letterhead, posters, brochures, or business cards.

4. As decoration in office, restaurant, public area, home, or store.

5. As a single reproduction painted on a canvas to be used as decoration or resold. (Not as a printed reproduction)

6. Create a derivative work as defined by the United States Copyright Act(1) and use such derivative work on t-shirts, mugs, calendars and mouse pads as well as "collections of items", including paper greeting cards, display/sale items, magnets and promotional items.

7. In coordination with opt-in email marketing. Images cannot be used in the body of unsolicited bulk email - or linked from unsolicited bulk email.

8. All other rights in the Photos are expressly reserved by Vilords media for itself and on behalf of the respective copyright holders.

User's Restrictions on the Use of AskPhotos.com photos

1. You may not at any time share, sell, give, or allow anyone to use your username/password, nor access your account for any reason.

2. Use or display any Photo on web sites designed to induce sales of "print on demand" products, including postcards, mugs, t-shirts, posters and other items.

3. You may not use any of the Photos downloaded or obtained from our web site in a Website template or any template or design sold individually or as part of an archive or catalog collection, or an automated shopping system, under any circumstances. You MAY however use our photos in client websites that are NOT distributed through an archive or automatic system.

4. You may not use a Photo with pornographic, defamatory, or otherwise unlawful or immoral content or in such a manner that it infringes upon any third party's trademark or intellectual property.

5. You may not use a Photo in a way that places a person in the photo in a bad light or depicts them in a way that they may find offensive - this includes pornography, tobacco ads, religious and political endorsements, defamatory, or otherwise unlawful or immoral content.

6. You may not resell any Photo.

7. You may not share a Photo by providing access on shared disk drives or network.

8. You may not use AskPhotos.com photos to compete with AskPhotos.com. This includes, by way of illustration, not by way of limitation, displaying images in any format (including thumbnails) for download on a website. Offering AskPhotos.com photos for sale, or including AskPhotos.com photo in templates for sale.

9. You may not use any Photo as part of a trademark or patent image.

10. You may not use any Photo as part of a logo.

11. You may not produce printed reproductions of any Photo on canvas or paper to be sold.

12. You may not use any download software, internet accelerators, or other similar software or automated programs to access or download any materials from our website at any time.

"Non-transferable" as used herein means that except as provided in this EULA, you may not sell, rent, load, give, sublicense, or otherwise transfer to anyone the Photo or the right to use the Photo. In addition, the work you produce with the Photo must be used for your direct employer, client, or customer, who must be the end user of your work. You agree to take all commercially responsible steps to prevent third parties from duplicating any Photo. This may include invisibly watermarking the image and identifying that AskPhotos.com owns the image on the document you intend to use the Photo.

If you plan on using photos for client work, you must keep accurate and detailed records of which clients you have used images/photos for. You may use AskPhotos.com images/photos for at most three (3) clients in any given month for each subscription you purchase. To determine the number of clients you can use photos for, multiply the number of months purchased by three. For example, if you purchase six months, you may service eighteen (18) clients during the period of your subscription. For bulk subscription or multiple seat licenses to service a large quanity of clients, please contact info@askphotos.com.

You agree that you will not share your access information. The username and password you use to purchase a subscription is to be used only by you. Each person that needs to login and use Photos needs to have their own account and purchase a subscription. You may use your subscription on ONE COMPUTER in your office or home at any one time. If any two users on two separate computers are using the same username and password, we reserve the right to terminate that account without refund or prior notice. We reserve the right to monitor accounts and institute mechanical or other means to stop users from sharing their login information.

This Agreement shall be governed by the laws of the State of Florida.

Additional rights to Photos are available. If you are unsure of your rights under this agreement, or if you wish to use an Photo in a matter not expressly permitted under this agreement, please contact AskPhotos.com for a special license. In most cases we can provide a license upgrade within 24 hours.

Subscriptions include 50 Photo downloads per day (up to 1500 per month). A month is defined as 30 days.

Vilords media makes no representations or warranties whatsoever as to the legality or validity of any Release associated with an Image.

Vilords media makes no representations or warranties whatsoever with respect to the use of names, trademarks, logos, uniforms, registered or copyrighted designs or works of art depicted in any Photo.
